Photography Terms and Conditions

 

It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

 

 

Booking Fee

A non-refundable  Booking Fee £300.00  is charged when the Client signs this contract, this fee is deducted (in full) from the total price.

 

Payments

Following payment of the booking fee the remaining balance is due to be paid on or before 30 days before the wedding date. Payment for additional images is to be made when they are ordered. Please make cheques payable to: Mike Hall.

 

Pre-Wedding Visits

Pre-wedding site visits by Nathan James Film Productions are available from Monday to Friday 9.30am  to 1.30pm  where practical and are subject to availability.  It is the responsibility of the client to arrange the visit 4 to 6 weeks before the wedding.

 

Display

The Client hereby allows The Photographer/s  to display any image/s included in this contract in their studios,  portfolio’s,  literature, wedding exhibitions and advertising.  No use of the images will be made by The Photographer/s  for other commercial reason except with the written permission of The Client.

 

Specified Photographs

Although every effort will be made to take any specified photographs, Nathan James Film Productions will not be responsible if, for any reason, these photographs are not delivered.

 

Images

All image sizes are nominal. The Photographer/s  will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film the exact colour as seen by the human eye.

 

Retouching

Retouching, digital manipulation and artist finishing is available to the Client as an optional extra. 

 

Reorders

All reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing.

 

Copyright

Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means, an image created as part of this contract without the permission of The Photographer/s  in writing.

 

Licence

The Photographer/s  shall be granted artistic licence in relation to the poses photographed and the locations used. The Photographers judgement regarding the locations/poses and number of images taken shall be deemed correct. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.

 

 

Force majeure or Act of God

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.

 

Limitation of Liability

In the unlikely event of total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract.  Neither party shall be liable for indirect or consequential loss.

 

Cancellation

The Client may cancel this contract at any time by giving written notice to The Photographer/s  but in doing so shall forfeit any monies paid. Should cancellation be received by The Photographer/s  less than 12 weeks prior to the date of the ceremony The Client shall, in addition, pay a sum equal to 100% of the contract value. The said sum shall be payable as compensation as an estimate of the loss The Photographer/s  would suffer. We do recommend that you take out some form of wedding cancellation insurance.

 

Negatives/Digital  Files

Negatives / digital files remain the property of The Photographers.

 

Photography

It is understood that no other professional photographer shall be allowed to photograph at the wedding while the photographer is working and that any breach of this agreement will constitute a reason for non-completion of the job with no liability to Nathan James Film Productions and loss of fee paid by the signing party.

 

Prices

All prices include the current rate of V.A.T. (if applicable).

 

Complaints

Any complaints should first be raised by the Client with the Photographer/s in writing within 21 days from the date of receipt of images.

 

Wedding Filming Terms 

 

 

 

1. Upon booking, a non-refundable deposit of £300 is required


2.A pre-wedding meeting will be arranged either at our premises or on location. 

3. The full balance is due 14 days prior to the wedding day. 

4. It is the responsibility of the client to obtain and pay for any permission to film within the church or place of service.  This is not the responsibility of Nathan James Film Production. In the 
event, this has not been obtained and filming cannot commence Nathan James Film Production cannot be held responsible for no footage and a refund will not be given.


5. In the event of equipment failure or illness, Nathan James Film Production shall not be liable for any compensation other than to refund the amount paid.  Nathan James Film Production is not accountable for any unforeseen problems that may occur on the way to the venues. Our equipment is regularly checked, but Nathan James Film Production is not held responsible under any circumstances for any unforeseen losses, omissions or problems, including emotional dismay, that could occur during filming. 

6. While all care, skill and diligence employed during filming it is understood that the event of any unforeseen circumstances causing loss of video or recording, liability will be limited to a full refund of any fees paid. 

7. It is a legal requirement to buy a wedding license in order to have any music from your service in your Film. This also applies to the reception. As the music/readings are your choice it is your responsibility to obtain this license, which can be done at www.videolicense.co.uk. (Average cost £25 ) This is not the responsibility of Nathan James Film Production.

8. Nathan James Film Production do not expect to sit down to eat with guests at the reception, however, it has also proved difficult to take sandwiches and a drink to a reception as the owners of hotels and clubs do not allow this, so when filming periods exceed 3 hours we will require arrangements for a meal (i.e. sandwiches & soft drink). 

9. SDHC Extreme Plus 80MB/s UHS 1 Memory Card records 113 minutes in length are equipment has space for two cards giving  226 minutes of continuous recording. We can use longer cards but need to know in advance. An additional charge may be required.  We will endeavour to ensure that cards do not need changing at crucial points but if this isn’t possible we are not liable for the omissions. (card changes take approximately 30 seconds). 

10. If you have booked Nathan James Film Production to film the first dance this can be no later than 8:30 pm, filming after this might incur an additional charge, unless agreed prior to the wedding day. 

11. Nathan James Film Production will endeavour to finish your Film within 6 - 8 weeks. If special effects are required more time will be needed to complete your Film.  we cannot be held responsible for not completing before the allotted time.

 

12. If the information supplied is incorrect and changes have to be made to the production of the DVD additional charges may be incurred. Charges: £60 per hour 

13. Nathan James Film Production archive a master copy of your Film for future duplication. Your Film will be held for no longer than1 year on a secure data storage device. (addition storage time is available)  Nathan James Film Production cannot be held accountable for any damage to this device and loss of your DVD. 

14. The final Film will be copyrighted to Nathan James Film Production, and copying the Film will breach of copyright law. Additional copies can be obtained at an additional charge.

15. We reserve the right to use any video footage filmed at your wedding to use in our promotional Film. You can request in writing to opt out of this. 

These terms and conditions of business and the contract between parties shall be construed and applied in accordance with the Law of England and shall be subject only to the jurisdiction of the English courts. 

 

 

 

Terms and Conditions: Aerial photography

Where additional costs have been identified during the pre-flight health and safety assessment, these costs must be paid in advance of works being undertaken and will be non-returnable. Pre-wedding site visits by Nathan James Film Productions will be made in order to assess the area in relation to the feasibility of flight and to conduct health and safety assessment. Should any additional requirements be identified during the visit additional costs may be required.

 

Pilots

All pilots must hold relevant qualifications and comply with CAA regulations as well as the companies flight safety case.

The pilot's decision on the feasibility of flight will be final.

 

Additional Costs

If the preflight health and safety assessment identifies procedures requiring additional staff or permissions to remain compliant with the CAA regulations. Should additional costs apply, you will be contacted with full details for you to agree prior to any further works taking place.

Should you decide not to proceed or sufficient works have been covered you will forfeit your deposit. Once this has been agreed You will not be reimbursed should the drone be unable to fly for any reason.

 

Display

Non Flight

Should the pilot feel it is unsafe to fly due to adverse weather conditions or events out of his/her control, a refund of £200 will be returned if full payment is made for the flight. If a discount is given then the difference between the deposit and the costs the payment made will be returned.

If addition costs are incurred (see Additional Costs) no refund will be made for the drone package even if adverse weather conditions prevent flight.

If the drone was unable to fly because of customer delays, the full charge will stand including additional costs and no refund will be given.

 

Negatives/Digital  Files
